Motorcycle Accidents
Like automobile accidents, the causes of motorcycle accidents range from a driver’s negligence or recklessness, to a defect in the vehicle or its component parts that renders the vehicle unreasonably dangerous, to faulty repair work by a mechanic, to improperly maintained roads. In motorcycle accident cases, however, an additional question is whether the motorcycle driver and passenger were wearing helmets. In South Carolina, there is no law requiring that a motorcyclist wear a helmet, but whether he or she was wearing a helmet at the time of an accident may be relevant to whether his or her damages could have been prevented or at least lessened.
